Austin, TX – The Texas Department of Insurance, Division of Workers’ Compensation (DWC) recently announced that it is accepting public comments on proposed amendments to 28 Texas Administrative Code (TAC) Section 133.30. The amendments conform Section 133.30 to Texas Occupations Code Chapter 111, which the Legislature amended under House Bill 2056 to define “teledentistry dental service.”
Section 133.30 (which has been in effect since May 6, 2018) sets billing requirements when a health care provider provides telemedicine and telehealth services. Currently, 28 TAC Section 133.30 has definitions for “telemedicine services” and “telehealth services,” but it does not define “teledentistry dental service.”
The proposed amendments add a definition for “teledentistry services” and a requirement that health care providers must bill for teledentistry services according to applicable Medicaid payment policies. The proposed amendments will not establish a new
reimbursement methodology for teledentistry but will require health care providers to use the existing dental reimbursement methodology in 28 TAC Section 134.303.
The proposed rule will be published in the June 23, 2023, issue of the Texas Register and available at www.sos.state.tx.us/texreg/index.shtml once published. TDI will also post a copy of the proposed rule on the TDI website.
