WCIRB: CA Commissioner Issues Decision on September 2023 Regulatory Filing

Oakland, CA – The California Insurance Commissioner issued a Decision on Wednesday regarding the Workers’ Compensation Insurance Rating Bureau of California’s (WCIRB’s) September 1, 2023 Regulatory Filing. The WCIRB submitted the filing to the California Department of Insurance (CDI) on February 27, 2023.

The Commissioner approved all of the WCIRB’s proposed changes to the California Workers’ Compensation Uniform Statistical Reporting Plan—1995 (USRP), California Workers’ Compensation Experience Rating Plan—1995 (ERP) and Miscellaneous Regulations for the Recording and Reporting of Data—1995 (Miscellaneous Regulations) that were proposed to take effect September 1, 2023. In addition, all of the proposed amendments to the USRP effective September 1, 2024 were approved as filed.

Availability of Experience Rating Information
The WCIRB will begin calculating September 2023 experience modifications within the next several days. Insurers, agents and brokers may access 2023 experience rating information via WCIRB Connect®.

Updated Regulations for September 1, 2023
The WCIRB is in the process of updating the USRP, ERP and Miscellaneous Regulations. Once complete, these documents will be posted to the Filings and Plans page of the WCIRB website. In the interim, the WCIRB has prepared the September 1, 2023 Regulatory Filing Quick Reference Guide: USRP and ERP Changes summarizing the approved changes to the Commissioner’s regulations.

Commissioner Approves Dividing Classification 9079(1), Restaurants or Taverns, into 6 New Classifications Effective September 1, 2024
The Commissioner’s Decision includes the approval of eliminating Classification 9079(1), Restaurants or Taverns, and establishing six new classifications for food and beverage service industry operations. Learn about these changes, effective for policies incepting on or after September 1, 2024, on the WCIRB’s website at the following link, which includes the new classification phraseologies:

  • Classification 9079(1), Restaurants or Taverns, to Be Divided into 6 New Classifications

The Commissioner’s Decision (PDF) pertains only to the WCIRB’s September 1, 2023 Regulatory Filing and does not address the WCIRB’s proposed September 1, 2023 changes to advisory pure premium rates filed with the Commissioner in April.
