Today’s issue of WorkCompRecap features NCCI’s release of its 2022 retrospective Court Case Update, which provides a look at some of the key cases and decisions monitored by NCCI’s Legal Division that may impact workers’ compensation across the US.
Key case items examined in 2022 included exclusive remedy, as court challenges to its constitutionality and scope continue to be closely watched. NCCI also continues monitoring COVID-19-related cases, many of which to date have dealt with whether contraction of COVID-19 is work-related and therefore compensable, or the application of exclusive remedy where employees contract COVID-19 and sue their employers in tort. In 2022 courts actively reviewed marijuana-related issues in workers’ comp and the workplace, with varying outcomes across the states.
