NV OSHA Issues 11 Citations for COVID-10 Violations in a Week

Las Vegas, NV – The Nevada Division of Industrial Relations (DIR) recently announced that violations of required workplace health and safety measures has resulted in Nevada OSHA issuing notices of citation and penalty to 11 businesses during the week beginning August 10.

Citations were issued to Purcell Tire & Rubber Company, The Tap (referral), Metro Pizza Northwest (referral), Mesquite Ford Lincoln RV, Walmart #3847, Neiman Marcus, Mesquite Lumber & Supply, Rock’s 76, 7-Eleven Store #29633D, U. S. Tire Center & Auto Repair, Inc., and El Tarahumara Auto Service. Total fines assigned to the businesses totaled over $73,000.

Citations were issued to Metro Pizza Northwest in Las Vegas and The Tap in Boulder City after an investigation was initiated as a result of a referral filed with Nevada OSHA alleging workplace safety hazards.

Nine citations were issued after officials observed noncompliance with one or more requirements of general and industry-specific guidance and directives during both an initial observation and a follow up visit by division officials. The employers were provided a notice and a request for compliance during the first visit. Upon observation of ongoing noncompliance during a follow up visit, a formal investigation was opened with the employer. In addition, a notice was provided indicating that in the event of future noncompliance, the Administrator may issue an order requiring the business to cease all activity at that location during this state of emergency under NRS 618.545(1) until the business has established and implemented operating procedures to comply with the requirements.

Initial Observations
Since observations began in late-June to determine compliance with mandated health and safety measures under the Governor’s Declaration of Emergency Directive 024 and Nevada OSHA’s Guidance for Roadmap to Recovery, DIR officials have conducted 6,145 initial visits at business establishments finding a cumulative 88 percent statewide compliance rate, a 90 percent compliance rate in northern Nevada and 87 percent compliance in southern Nevada.

During the week beginning August 10, officials conducted 705 initial visits across the state at a wide range of business sectors finding an 87 percent compliance rate statewide.

Cities with compliance rates below the statewide average of 87 percent during the week beginning August 10 include:

  • Dayton- 50 percent
  • Mound House- 50 percent
  • Carlin- 60 percent
  • Stagecoach- 60 percent
  • Battle Mountain- 83 percent
  • Virginia City- 85 percent
  • Jackpot- 86 percent
  • Las Vegas- 86 percent
  • Henderson- 86 percent

Cities with initial observed compliance rates at or above 90 percent during the week beginning August 10 include:

  • Boulder City- 100 percent
  • Carson City- 100 percent
  • Silver Springs- 100 percent
  • Spring Creek- 94 percent
  • Wells- 92 percent
  • Wendover- 92 percent
  • Reno- 91 percent
  • Elko- 90 percent

Initial compliance rates for business sectors across the state (where 25 or more observations were conducted, except where noted) during the week beginning August 10 include:

  • Automobile Sales and Service- 68 percent compliance
  • Other- 77 percent
  • Medical- 83 percent
  • General Retail- 85 percent
  • Clothing Stores- 90 percent
  • Hair, Nail and Tattoo Salons- 91 percent
  • Convenience Store- 91 percent
  • Grocery Stores- 92 percent
  • Restaurants- 94 percent
  • Gyms (22 observations)- 96 percent

Follow Up Observations
Since observations to determine compliance with mandated health and safety measures began, DIR officials have conducted 741 follow up visits finding a 94 percent statewide compliance rate with a 96 percent compliance rate in northern Nevada, and 92 percent in the south.

During the week beginning August 10, officials conducted 117 follow up visits finding a 92 percent compliance rate statewide. Business sectors with compliance rates lower than the 92 percent statewide compliance rate include:

  • Clothing Stores, 3 observations- 67 percent
  • Grocery Stores, 7 observations- 71 percent
  • Automobile Sales/Service, 7 observations- 71 percent
  • Gyms, 7 observations- 86 percent
