Today’s issue of WorkCompRecap features the recent announcement from PCI that NCCI has prevailed in its appeal in Florida, where the Florida First District Court of Appeals has ordered a full reversal of the lower court decision, upholding the 14.5% rate increase that was approved by the Florida Office of Insurance Regulation.
The 14.5% rate filing had come after the Florida OIR rejected NCCI’s initial proposal of a 19.6% rate increase earlier last year. The filings were in direct response to two Florida Supreme Court rulings, Bradley Westphal v. City of St. Petersburg et al, and Castellanos v. Next Door Co., the latter of which undid workers’ compensation attorney fee reforms that were put in place in 2003. While the 2017 Legislative Session ended earlier this week, PCI noted that work with lawmakers needs to continue in order to ensure the state returns to a marketplace that works for all stakeholders.
