Today’s issue of WorkCompRecap features the joint announcement from the Pennsylvania Department of Labor and Industry and U.S. Department of Labor Wage and Hour Division that they have signed a three-year Memorandum of Understanding aimed at protecting workers’ rights by preventing their misclassification as independent contractors or other non-employee statuses.
As part of the agreement, the organizations will collaborate on outreach programs to inform employers, employees and other stakeholders, conduct coordinated investigations, and share information and resources to increase enforcement of misclassified worker laws. The U.S. DOL is working with the IRS and 31 other U.S. states (including the NYS WCB) to combat employee misclassification, which it noted not only deprives workers of their rights, but also creates losses for state unemployment insurance and workers’ compensation funds.
