Today’s issue of WorkCompRecap features the recent introduction of bipartisan legislation that aims to clarify and improve the government’s processes for dealing with Workers’ Comp Medicare Set Asides.
According to the AIA, who praised the move, some of the major tenets include establishing consistent standards for determining amounts to be set-aside, providing a reasonable time frame in which CMS is to review set-aside submissions, providing an appeals process, and assuring that settlements are not disapproved based on later changes in law, regulations or administrative interpretations.
