Today’s issue of WorkCompRecap features the release of a new study from CWCI on attorney involvement in workers’ comp cases that analyzed closed and resolved work injury claims from accident years 2005 through 2010, and found that attorneys were involved in 11.6% of all claims (including medical-only), 38% of lost-time claims and 80% of permanent disability claims.
The study also found that Los Angeles and the surrounding areas continue to be a hotbed for litigation. While the statewide involvement rate for closed and resolved indemnity claims came in at 38%, the Los Angeles Basin posted a 46% involvement rate for all lost-time cases. Several areas in Southern California also posted the lowest closure rates for attorney involvement claims in the state, while average claim costs are among the highest.
