Today’s issue of WorkCompRecap features some legal news as the Ohio BWC recently filed the opening brief in its appeal of the decision in San Allen, Inc. et al vs. Stephen Buehrer, Administrator, BWC. Buehrer noted that the BWC has maintained its belief that it acted within its authority in establishing rates.
A coalition of of business and labor associations has filed an Amicus brief also, noting their belief that BWC acted within its legal authority. Others in the business community also cast doubt on whether those in the class were truly harmed, pointing out that class members received more in benefits than they paid, and many benefitted from group rating for at least part of the class period.
