Today’s issue of WorkCompRecap features an update from California’s DWC on the implementation of SB 863, which will be effective on January 1. According the DWC, they are taking a “balanced approach” that will reflect the bill’s intention to balance substantial benefit increases to injured workers with efficiencies and cost savings to employers.
Some items will go into effect without any regulatory action, such as an increase of approximately 30% in permanent disability indemnity benefits for injuries on or after January 1. DWC’s legal staff has also initiated the emergency rulemaking process for items requiring implementation through regulation, including IMR and IBR processes, lien activation and lien filing fee payment, QME changes, supplemental job displacement benefits, and interpreter certification – all of which will be followed by the full rulemaking process over the next year.
