Today’s edition of WorkCompRecap features the recent announcement from Texas Mutual of the Texas Supreme Court’s ruling in the case Texas Mutual Insurance Company v. Timothy J. Ruttiger. The Court found that a bad faith cause of action is inconsistent with the current workers’ compensation system, which Texas Mutual called a “landmark” ruling, and indicated it would strengthen the Workers’ Compensation Act. The AIA also weighed in on the decision, with Associate General Counsel and Director of Workers’ Comp Bruce Wood noting that the decision can be expected to enhance market stability and eliminate unnecessary litigation over claims practices. AIA also noted that the decision brought a successful conclusion to their efforts to reverse the 1988 Aranda decision, which began over three years ago.
