Today’s edition of WorkCompRecap features some news from the Worker’s Compensation set-aside arena, as the American Insurance Association has recently voiced their support for a new piece of bipartisan legislation, “The Medicare Secondary Payer and Workers’ Compensation Settlement Agreement Act of 2012,” by Rep. Dave Reichert (R-WA) and Rep. Mike Thompson (D-CA). The new bill aims to resolve “routine delays and confusion” in the review of workers’ compensation Medicare set-asides by the Centers for Medicare and Medicaid Services (CMS). Also in the news today is a new report from the Illinois Auditor Generals’ Office on their audit of the Workers’ Compensation Program as it applies to State employees. The report identifies what they believe to be “numerous shortcomings” in both the structure and operation of the program. Major points included incomplete, inaccurate, and inconsistent data, a lack of guidelines for Arbitrators regarding awards, and a 3.5 year gap in review board meetings for complaints against Arbitrators and Commissioners.
