Today’s issue of WorkCompRecap features the Ohio BWC’s recent announcement that it has approved a “first fill” rule which aims to ensure that injured workers receive necessary medications while the future of their claim is being determined.
BWC noted the importance of the rule, especially in situations where workers do not have health insurance or are otherwise unable to pay bills while they wait for claim approval. The rule will apply to new injuries and allows for immediate filling of prescriptions for acute injury medications prior to formal claim approval. Notably, “extemporaneous compounds” are excluded from reimbursement. If approved by the Joint Committee on Agency Rule Review, the rule is expected to become effective Feb. 1, 2015.
